Mobile SMS Terms of Use

1) Overview

By opting in to receive mobile text messages from The Men's Shop Co. (the "Program"), you agree to these Mobile SMS Terms of Use (the "SMS Terms"), our Purchase Terms & Conditions, and our Privacy Policy (collectively, the "Policies"). The Program provides account alerts, order updates, and marketing messages.

2) Opt-In & Consent

• You may opt in by submitting your phone number at checkout or via designated site forms, and confirming where required (e.g., double opt-in).
• By opting in, you authorize us to send recurring SMS or MMS messages using an automated dialing system. Consent is not a condition of purchase.
• Message frequency varies by user activity and promotions.

3) Opt-Out / STOP

• Reply STOP to any message to cancel. After texting STOP, you may receive a confirmation message and then will no longer receive messages.

5) Charges & Eligibility

Delivery of messages is subject to effective transmission by your carrier and network providers. Carriers are not liable for delayed or undelivered messages.

7) Data Collection & Privacy

We collect your phone number, message content, delivery status, and related metadata to operate the Program. We handle personal information in accordance with our Privacy Policy, including your rights and choices. Do not use the Program to send us sensitive information.

8) Account Changes

• If you change, transfer, or deactivate your mobile number, you must promptly opt out of the Program for that number.

9) Program Changes & Termination

• We may modify, suspend, or end the Program at any time, with or without notice, consistent with applicable law. Updates become effective when posted on this page.

10) Disclaimer; Limitation of Liability

THE PROGRAM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE MEN'S SHOP CO. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR PARTICIPATION IN THE PROGRAM. OUR TOTAL LIABILITY SHALL NOT EXCEED FIFTY U.S. DOLLARS (US$50) OR THE AMOUNT YOU PAID TO ENROLL, IF ANY.

11) Disputes; Governing Law

These SMS Terms are governed by the laws of the State of California and the United States as applicable, without regard to conflict-of-law principles. Any disputes arising from or relating to the Program shall follow the dispute resolution terms set forth in our Purchase Terms & Conditions, including any arbitration and class-action waiver provisions therein.
